Halle Berry just lost primary custody of her 12-year-old son, at least for now.
Her ex-husband Olivier Martinez went to court Thursday, filing for sole custody and a temporary restraining order. In the filing, he accuses Berry of choking their son Maceo during an argument on September 26, jumping on the boy and putting her hands around his neck. He also claims it was not the first time.
A judge granted the temporary order. Berry’s visits with Maceo are now limited to daytime hours, and she has to stay 100 yards away from Martinez, until a hearing on October 16 decides whether the order becomes permanent.
Berry’s attorney Marina Beck says the filing is “entirely meritless and deliberately misleading,” and claims Martinez has a documented history of violating court orders and has already been legally sanctioned for it.
The two finalized their divorce in 2023 after an eight-year legal battle, with joint custody and Berry paying Martinez $8,000 a month in child support.
